These Terms of Use govern access to and use of Move78 websites and online services that link to these Terms. They are intended to sit alongside the Move78 Privacy Policy and any separate customer, program, subscription or participant agreement.
By accessing or using a Move78 website, assessment, Academy78 learning experience, digital resource or other online service that links to these Terms, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the applicable service.
Move78 provides workforce capability, AI readiness, digital reskilling, competency assessment, learning, advisory, research and related services. Certain programs or client engagements may also be governed by a separate proposal, statement of work, subscription agreement, participant notice or other contract. If a separate written agreement conflicts with these Terms, the separate agreement governs to the extent of the conflict.
Website content, assessments, frameworks, articles, research, workshops and learning materials are provided for educational and informational purposes. They are not legal, accounting, financial, medical, employment or other regulated professional advice.
Organizations and individuals remain responsible for evaluating how information, recommendations and AI-generated or technology-assisted outputs apply to their circumstances.
Move78 assessments are intended to support learning, workforce development, benchmarking and capability planning. Results reflect the information available to Move78, including participant responses and the design of the applicable assessment.
Assessment scores, competency levels, recommendations and learning pathways should not be treated as guarantees of job performance, professional qualification or future results.
Unless expressly agreed in writing, Move78 assessments are not designed to be the sole basis for hiring, termination, promotion, compensation or other high-impact employment decisions.
Academy78 and related adaptive learning services may use assessment responses, learning progress or other inputs to recommend or route learners to content appropriate to their current knowledge, role or development needs.
Learning pathways may change as content, technology, assessment methods and program requirements evolve. Completion of a course or module does not by itself guarantee competency, certification, business results or regulatory compliance.
Move78 may teach or demonstrate third-party AI tools, software and digital platforms. These tools may produce inaccurate, incomplete, biased or otherwise unsuitable outputs.
Users are responsible for applying appropriate human review, protecting confidential and personal information, following employer policies, respecting intellectual-property rights, and complying with applicable laws and contractual obligations when using AI or other technology.
If a Move78 service requires an account, you are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account.
You must provide accurate information, use the service only for authorized purposes, and promptly notify Move78 if you suspect unauthorized access or misuse.
You may not use Move78 websites or services to violate law; infringe intellectual-property or privacy rights; attempt unauthorized access; interfere with service operation; upload malicious code; scrape, copy or systematically extract content except as permitted; impersonate another person; circumvent access controls; or use the service in a manner that could harm Move78, its customers, participants or service providers.
Unless otherwise stated, Move78 owns or licenses the website content, course materials, graphics, assessments, methodologies, program names, written materials, templates and other content made available through its services.
Move78 intellectual property includes, where applicable, the 7 Levels of AI Competency, Raise the Floor, Academy78, Adaptive Digital Reskilling, NextStep / LevelUP, Moneyball for Distributors, related assessment structures, program materials and branded graphics.
Nothing in these Terms transfers ownership of Move78 intellectual property. You may use materials only for the purpose and within the scope for which they were provided, unless Move78 gives written permission for broader use.
If you submit comments, feedback, testimonials, questions or other content, you represent that you have the right to provide it and that doing so does not violate another person’s rights.
Move78 may use general feedback to improve its services. Move78 will not publicly identify you or attribute a testimonial to you without appropriate permission.
Move78 services may integrate with or link to third-party websites, AI systems, learning platforms, payment processors, analytics providers or other technology services. Those services are governed by their own terms and privacy practices.
Move78 does not control and is not responsible for third-party services, availability, outputs, security or content.
Where a Move78 service requires payment, the applicable price, payment schedule, cancellation terms and refund terms will be stated at the point of purchase or in a separate proposal, order form or agreement.
Unless otherwise stated in writing, fees paid for completed assessments, delivered digital content, completed workshops or services already performed are non-refundable to the extent permitted by law.
Move78 may update, modify, suspend or discontinue website features, learning content, assessments or digital services as the business, technology or applicable requirements evolve.
We do not guarantee uninterrupted or error-free access. Planned or unplanned outages may occur, including outages caused by third-party providers.
To the maximum extent permitted by applicable law, Move78 websites and online services are provided on an “as is” and “as available” basis. Move78 does not warrant that content is complete, current, error-free or suitable for every purpose, or that digital services will operate without interruption.
Nothing in these Terms excludes warranties, conditions or rights that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Move78 will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the website or online services, reliance on educational content, third-party technology, or loss of data, business opportunity or profits.
Where liability cannot lawfully be excluded, Move78’s liability will be limited only to the extent permitted by applicable law. Separate client agreements may contain different liability terms.
To the extent permitted by law, you agree to be responsible for losses, claims or expenses arising from your unlawful use of the services, your violation of these Terms, or your infringement of another person’s rights.
Personal information collected through Move78 websites and services is handled in accordance with the Move78 Privacy Policy and any additional privacy notice presented for a specific assessment, program or client engagement.
Move78 may restrict or terminate access to an account or service where reasonably necessary to protect security, enforce these Terms, respond to unlawful or abusive conduct, comply with legal requirements, or address non-payment or material breach of a separate agreement.
Unless a separate written agreement states otherwise, these Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.
Subject to any mandatory rights or forum requirements that apply by law, disputes relating to these Terms will be brought before the courts located in Alberta, Canada.
Move78 may update these Terms from time to time. The current version will be posted with the effective or last-updated date. Continued use of a service after revised Terms take effect constitutes acceptance where permitted by law.
